General Terms and Conditions (AGB)

Platinum Shuttle Chauffeur Service – Owner: Kay Schaller
(“hereinafter referred to as Platinum Shuttle”)

I. Scope and Changes to the Terms and Conditions

These General Terms and Conditions (GTC) apply to:

  • the use of the website www.platinumshuttle.de as well as all related websites and apps (“Platform”),
  • all orders and arrangements of chauffeur, mobility, and logistics services (“Services”) via the Platform, by email or telephone,
  • the provision of the ordered Services by Platinum Shuttle or its cooperation partners.

Platinum Shuttle reserves the right to change these Terms and Conditions at any time. Users will be notified of changes via email, and changes will be considered accepted if the user does not object within four weeks. Users will be explicitly informed about the right to object and its deadline in the notification.

II. Registration and Contract Conclusion

Registration is required to use the Platform, which is free of charge and requires acceptance of these Terms and Conditions. Registration is done via the Platform or by telephone. The contract is concluded upon confirmation by email from Platinum Shuttle. There is no entitlement to registration.

The user is obliged to provide complete and correct information and to keep it up to date at all times. Registration may only be carried out by fully capable natural persons or authorized representatives of legal entities. Multiple registrations are not permitted.

III. User Obligations

The user is obliged to keep their access data secret and not make it accessible to third parties. The user is liable for all activities on their account unless they are not responsible for the misuse. Suspected cases must be reported immediately.

The user must not impair the integrity of the Platform or block or alter any content. Platinum Shuttle is not liable for the permanent availability of stored data; users are obliged to archive independently.

IV. Contract Conclusion and Contract Transfer

Individual contracts for Services are concluded via the Platform, by email, or by telephone. Platinum Shuttle decides whether a Service is provided by itself or executed by a cooperation partner. Platinum Shuttle is entitled to transfer already concluded contracts to cooperation partners and informs the user about this in due time by email.

V. Cancellations and Waiting Times

Cancellations are made according to the conditions available on the website under Booking Conditions. Cancellations must be made via the Platform, by email, or by telephone. Platinum Shuttle confirms cancellations by email.

VI. Fees, Payment Terms, and Invoicing

All prices include statutory VAT. Payments are made through the payment methods agreed upon on the Platform or as arranged. Invoices are generally sent electronically and are due within 7 days of receipt.

Additional services (e.g., waiting times, additional kilometers) are charged separately. In case of early termination of the journey, the agreed fee remains due, minus saved expenses.

VII. Liability

Platinum Shuttle and its cooperation partners have unlimited liability for intent, gross negligence, and damages to life, body, or health. For slight negligence, liability exists only for the breach of essential contractual obligations, limited to foreseeable, contract-typical damages. Platinum Shuttle is not liable for services provided by third parties.

VIII. Force Majeure

In the event of force majeure (e.g., weather events, technical failures) that prevent the provision of the Service or the operation of the Platform, the obligation to provide the service ceases. In such cases, Platinum Shuttle will endeavor to find an alternative solution.

IX. Final provisions

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants is Berlin. All declarations must be in text form.

Should individual clauses be invalid, the validity of the remaining provisions remains unaffected (severability clause).
