The Platinum Shuttle apps are another way to access our service. The Platinum Shuttle apps generally process personal data in the same way as the Platinum Shuttle websites.

When using the Platinum Shuttle app, Platinum Shuttle can also access additional data relating to the app or your end device, such as the device name, device manufacturer, model, operating system, app or SDK version, mode.

There are also push notifications in the Platinum Shuttle app, i.e. messages initiated by Platinum Shuttle in the app on your end device. You will only receive push notifications if you have consented to this on your end device. The legal basis for data processing is Art. 6 para. 1 lit. a GDPR (your consent).

A separate Platinum Shuttle App (“Driver App”) is provided for Platinum Shuttle employees and cooperation partners. Among other things, the name of the guest, date and time of the transfer, flight details and pick-up and destination addresses are transmitted via the driver app for the purpose of order fulfillment. The data is only transmitted for the purpose of fulfilling the order; the data is automatically deleted after the journey has ended.

9. data processing during registration and use (of Platinum Shuttle Services and booking of journeys)

Platinum Shuttle processes the following personal data provided by you when you register and use the Platinum Shuttle services or when you book journeys (hereinafter referred to as “customer data”):

  • Personal master data (salutation, title, first name, surname, company, address, zip code, city, country, password);
  • Contact details (e.g. telephone number, cell phone number, e-mail address);
  • Contract data (e.g. time and type of registration, status);
  • Journey-related data (e.g. pick-up location, destination, times, flight number, instructions for the driver);
  • Customer history (e.g. previous journeys);
  • Contract billing data (e.g. invoices, status, billing address) and payment data (e.g. your PayPal address or bank details for the SEPA procedure. Credit card details are not stored by Platinum Shuttle at any time).

The customer data is used for the Platinum Shuttle Services, i.e. for the personalized fulfilment of the registration relationship (creation, storage, administration and support of your account), for the execution of the business transaction for booking a journey and for the fulfilment of your transport contract with the transport service provider. Platinum Shuttle passes on customer data to third parties, in particular to transport service providers, where necessary, so that the customer can be transported in accordance with their booking and the transportation can be processed. The payment data collected is stored by a payment service provider and transmitted to the financial services institutions or banks involved (see section 10.).

Personal data may be transferred to service providers in a third country outside the European Union or the European Economic Area in order to provide our services. Platinum Shuttle has suitable guarantees for these service providers in the form of an order data processing contract (see Art. 46 GDPR) to ensure the level of data protection. For the transfer of your data to travel service providers in a third country outside the European Union or the European Economic Area where the journey is scheduled to take place. As a rule, Platinum Shuttle cannot provide any further information on the level of data protection in the third country. In such a case, the personal data will be reduced to the minimum necessary (first name, surname, pick-up and destination address) to carry out your journey. An adequacy decision (see Art. 45 para. 3 GDPR) or appropriate safeguards (see Art. 46 GDPR) are not required for the transfer, as the transfer is necessary for the performance of a contract between the data subject and the controller or for the implementation of pre-contractual measures at the request of the data subject (Art. 49 para. 1 lit. b GDPR) or because the transfer is necessary for the conclusion or performance of a contract concluded by the controller with another natural or legal person in the interest of the data subject (Art. 49 para. 1 lit. c GDPR).

The legal basis for the processing of personal data for the registered use of the Platinum Shuttle Services and for the booking of journeys is Art. 6 para. 1 lit. b GDPR (fulfillment of contract). Insofar as the data subject provides additional, voluntary information (e.g. flight number, information to the driver), the legal basis is their consent pursuant to Art. 6 para. 1 lit. a GDPR and our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR.

Platinum Shuttle also processes customer data in order to analyse, personalize and improve the use of Platinum Shuttle services, to identify, limit and eliminate technical or process-related faults and problems, and to prevent unlawful use of Platinum Shuttle services (e.g. fraudulent bookings, cyber attacks). The legal basis for the processing of personal data in this respect is Art. 6 para. 1 lit. f GDPR (legitimate interest of Platinum Shuttle). In this respect, the data will not be passed on to recipients unless to Platinum Shuttle’s processors (see Art. 28 GDPR) or if otherwise permitted by law.

10. credit card data

All bookings with Platinum Shuttle can be paid by credit card. Credit card details only have to be entered once when booking for the first time and are protected against unauthorized access. A certified payment provider (Stripe) is used for this, whose systems meet the applicable security standards, such as the PCI DSS standard (Payment Card Industry Data Security Standard). For recurring transactions, the credit card data is stored with the commissioned PCI DSS-certified payment provider. The legal basis for the processing in this respect is Art. 6 para. 1 lit. b GDPR (fulfillment of contract).

Platinum Shuttle itself does not store credit card data at any time and has no authorization to access the provider’s data. The legal basis for this is Art. 6 para. 1 lit. f GDPR (legitimate interest of Platinum Shuttle).

11. communication with Platinum Shuttle

If you contact Platinum Shuttle (e.g. by phone call, contact form, Facebook Messenger or email), the data you provide will be processed to handle your request and respond to your query. The legal bases are Art. 6 para. 1 lit. a GDPR (consent) and Art. 6 para. 1 lit. b GDPR (contract fulfillment and contract initiation).

Platinum Shuttle also uses data from the contact – where possible pseudonymized or anonymized – to design and improve our service in line with requirements, to identify and eliminate technical or process-related faults and problems and to prevent illegal use of Platinum Shuttle services (e.g. fraudulent bookings, cyber attacks). The legal basis for the processing of personal data in this respect is Art. 6 para. 1 lit. f GDPR (legitimate interest of Platinum Shuttle).

12. rights of data subjects

If your personal data is processed by Platinum Shuttle, you are the data subject (Art. 4 No. 1 GDPR). As a data subject, you have the following rights with regard to your personal data:

 

12.1. Right to information (Art. 15 GDPR)

The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and further information on the data processing.

12.2. Right to rectification (Art. 16 GDPR)

The data subject shall have the right to obtain from the controller without undue delay the rectification or, where applicable, completion of inaccurate personal data concerning him or her.

12.3. Right to erasure (Art. 17 GDPR)

The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where the data are no longer necessary, the data subject withdraws consent or objects to processing, the personal data have been unlawfully processed or where there is another ground for erasure pursuant to Art. 17 GDPR and the controller has no right to object to the erasure.

12.4. Right to restriction of processing (Art. 18 GDPR)

The data subject has the right to obtain from the controller restriction of processing where one of the conditions set out in Art. 18 GDPR applies, for example where the accuracy of the personal data is contested by the data subject or the processing is unlawful and the data subject opposes the erasure of the personal data.

12.5. Right to object (Art. 21 GDPR)

Insofar as the data processing is based on a legitimate interest on our part (Art. 6 para. 1 lit. f GDPR) or it concerns direct advertising, the data subject has the right to object to the processing of personal data concerning him/her at any time for the reasons stated in Art. 21 GDPR. The controller will then no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.

12.6. Right to data portability (Art. 20 GDPR)

Pursuant to Art. 20 GDPR, the data subject has the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and has the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.

12.7. Right to lodge a complaint (Art. 77 GDPR)

Without prejudice to any other legal remedies, every data subject has the right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR.

13 Data erasure and storage duration

We delete your personal data as soon as the legal basis for its processing no longer applies. In some cases, however, legal bases can also exist in parallel or a new legal basis can intervene if a legal basis ceases to exist, such as, for example, the following. the obligation to store certain data to fulfill a statutory retention obligation (e.g. under applicable commercial or tax law).

We use Google Adwords to draw attention to our offers with the help of advertising material (so-called Google Adwords) on external websites. The cookie for conversion tracking is set when a user clicks on an AdWords ad placed by Google. Cookies are small text files that are stored on your computer system. These cookies generally lose their validity after 30 days and are not used for personal identification. If you have visited a certain page and the cookie has not yet expired, Google and we can recognize that you have clicked on the ad and have been redirected to this page.
